Search Incident to Lawful Arrest\nA search incident to lawful arrest\ndoes not require issuance of a\nwarrant. In other words, if someone\nis lawfully arrested, the police may\nsearch her person and any area\nsurrounding the person that is within\nreach (within his or her\n“#wingspan”). See Chimel v.\nCalifornia, 395 U.S. 752 (1969). The\nrationale is that the search is\npermissible as a protective measure\nfor police safety and to secure\nevidence that might be destroyed.\nEXAMPLE: Pursuant to an arrest\nwarrant, John is taken into custody in\nhis home. As the police escort John\nout of his house, they search the\narea within his wingspan. After\nsecuring John in his vehicle, the\nofficers search the basement of the\nhouse. Any evidence gathered from\nthe basement will be excluded\nbecause it was not within John’s\n#wingspan as he left the home.\n\n\n• In certain situations an investigatory\nsearch may take place without the\nwarrant.
